Welcome to Labels Be Gone (“we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your use of www.labelsbegone.com (the “Site”) and any related services, including purchases, community participation, digital downloads, and communications.

By accessing or using our Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please discontinue use immediately.

1. Eligibility
You must be at least 18 years old (or the age of majority in your state) to use this Site or make purchases. By using the Site, you represent that you meet these requirements and have the authority to agree to these Terms.

2. Use of the Site
You agree to use the Site only for lawful purposes and in compliance with all applicable federal and Texas state laws, including the Texas Business & Commerce Code § 17.46 et seq. (Deceptive Trade Practices Act).
You must not:

  • Interfere with or damage the Site’s operation;
  • Attempt unauthorized access to data, systems, or networks;
  • Use the Site to transmit unlawful, harassing, defamatory, or infringing material;
  • Misrepresent your identity or affiliation with any person or entity.

3. Products and Orders
All prices and product descriptions are subject to change without notice.
We reserve the right to:

  • Refuse or cancel any order at our discretion;
  • Limit purchase quantities;
  • Correct errors or inaccuracies (even after an order has been submitted).

By submitting an order, you represent that all information you provide is accurate and complete.

All transactions are governed by Texas law, and risk of loss passes to you upon delivery to the carrier.

4. Payments

We use secure third-party processors (e.g., Stripe, PayPal, WooCommerce Payments) to process payments. By providing payment information, you authorize us and our payment partners to charge the specified amount.

Sales tax will be collected in accordance with Texas Tax Code § 151.101 and any applicable out-of-state requirements.

5. Shipping and Fulfillment

We fulfill orders within the estimated timeframes noted on the Site. Delivery times may vary due to postal or carrier delays.

Texas Notice: Under the Texas Business & Commerce Code § 601.052, if you purchase any goods or services primarily for personal, family, or household purposes and a refund policy applies, that policy will be clearly disclosed at checkout.

6. Returns and Refunds

Return and refund eligibility is described in our Refund & Shipping Policy available on the Site. You must follow those procedures to initiate a return.

7. Intellectual Property

All Site content—including text, images, graphics, logos, designs, and trademarks—is owned or licensed by Labels Be Gone, LLC and protected under U.S. and Texas copyright law (Tex. Civ. Prac. & Rem. Code § 16.003).

You may not reproduce, distribute, modify, or create derivative works without written permission.

8. The Living Room Collective

Membership in The Living Room Collective grants access to community content, discussions, and events.
By participating, you agree:

  • To treat all members with respect and maintain confidentiality of private discussions;
  • Not to share community materials outside the group;
  • To refrain from harassment or harmful conduct.

Violation may result in suspension or termination of membership without refund.

9. Digital Downloads and eBooks

All digital purchases (e.g., journals, eBooks, reflection guides) are for personal use only and may not be redistributed or resold.
Downloads are provided “as is,” and we are not liable for compatibility issues beyond our control.

10. Disclaimer of Warranties

The Site and all products and services are provided “as is” without warranties of any kind, express or implied.
We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted under Texas law.

11. Limitation of Liability

To the maximum extent permitted by law, Labels Be Gone and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or products.

Under Texas Civil Practice & Remedies Code § 41.001 et seq., any recovery shall not exceed the total amount paid for the product or service giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Labels Be Gone, LLC, its officers, employees, and affiliates from any claim or demand arising from your breach of these Terms or misuse of the Site.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute shall be resolved exclusively in the state or federal courts located in Dallas County, Texas.
You consent to that jurisdiction and waive any objection to venue.

Notice Required by Texas Law:
Under Texas Business & Commerce Code § 17.505, before filing a claim under the Texas Deceptive Trade Practices Act, you must send written notice of the complaint to Labels Be Gone at least 60 days before filing suit.

14. Termination

We may suspend or terminate your access to the Site or services at any time, for any reason, without notice. Sections relating to intellectual property, limitation of liability, and dispute resolution will survive termination.

15. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the latest revision. Continued use of the Site after changes means you accept the new Terms.
